Police say Rutledge was having a snowball fight with friends when Mendez was accidentally struck. They say he went home, returned with a gun and shot Rutledge in the side of the head. Rutledge died a day later.
Jurors are being picked Tuesday and attorneys for both sides say opening statements could begin Wednesday.
