Simon says in her lawsuit the album was not available in a
substantial number of Starbucks stores during the first months of
its release. She says later the CD was stocked at a reduced price,

New York and Boston. The New York Times says the album sold only
124,000 copies. Simon will release a new album, "Never Been Gone,"
later this month.
