Judge mulls couple's degree of guilt in murder

NORRISTOWN, Pa. (AP) - November 17, 2009

Twenty-one-year-old Jeffrey Leinheiser and 23-year-old Christina Rubin pleaded guilty last summer to an open charge of murder in the death of 46-year-old Marc Rubin, whose body was found in the Pine Barrens in New Jersey in December.

Montgomery County prosecutors say Rubin was shot execution-style on Nov. 28, but his body was left in his apartment for more than a week before it was dumped.

Prosecutors call it "a premeditated intentional killing," saying the Jenkintown couple had a plan and implemented it.

But defense attorneys say manslaughter would be more appropriate, and Rubin's attorney says she will use a "battered women's syndrome" defense.
