DA: Fmr. band volunteer had sex with teens

NORRISTOWN, Pa. - May 23, 2012

Steven Fitzgerald, 24, is charged with Statutory Rape, Involuntary Deviant Sexual Intercourse, Sexual Assault, Indecent Assault and Corruption of Minors.

Montgomery County District Attorney Risa Vetri Ferman said, in 2010, Fitzgerald served as a volunteer band technician for the Norristown Area High School Marching band.

During that time, the D.A. said, Fitzgerald texted and Facebook chatted with one of the 15-year-old victims in an attempt to start a sexual relationship.

Investigators say, in May 2010, Fitzgerald picked up the victim and her 15-year-old friend after school and drove them to an abandoned parking lot. The D.A. said that is where Fitzgerald assaulted the first victim. He then allegedly drove his car to another location and sexually assaulted the second victim.

Then, the D.A. said, Fitzgerald communicated with both female victims last week in an attempt to meet up for further sex acts. He was arrested after this incident.

Fitzgerald was arraigned on Tuesday and bail was set at $100,000 with a preliminary hearing set for early June.
