Ocean County prosecutors say that will not affect charges against the suspected drunken driver accused of hitting /*Alexis Cohen*/.
Officials say Cohen had alcohol in her system and the 25-year-old Allentown, Pa., resident was not under the influence of narcotics as she walked in Seaside Heights around 4 a.m. on July 25.
/*Daniel Bark*/ is charged with leaving the scene of a fatal accident while eluding police, aggravated manslaughter, vehicular homicide and driving while intoxicated.
Police say Bark was fleeing police on bicycles after hitting a parked car when they say he struck Cohen. She had performed during "American Idol's" seventh season.
