An attorney for Richard Checchia and Stanley Dawejko filed the federal suit Wednesday.
The suit says Officer Thomas Schaffling was intoxicated when he encountered the men outside the Yik Yak club on March 26 while looking for his car.
It alleges a scuffle ensued after Schaffling kicked in a tail light of Checchia's car.
Schaffling allegedly threw one man to the ground and fired several shots; both men suffered minor injuries.
The lawsuit says responding officers tried to cover up the incident.
A police spokeswoman declined comment.
A telephone number for Schaffling couldn't be located; it wasn't immediately clear if he had an attorney.
