Police search for 2nd gunman in Del. store shooting

WILMINGTON, Del. - January 27, 2012

It happened at 11:00 p.m. Thursday night in Wilmington.

Police say a 21-year-old man was getting out of his car near La Flor's Deli and Subs at 1100 West 2nd Street when two armed men began chasing him.

Police say the suspects, armed with a .22 caliber pistol and a .44 caliber rifle, fired numerous shots at the man as he ran into La Flor's, continued running through the store and out the back door. They say the suspects kept firing as the man fled south on Van Buren Street.

The suspects gave up the chase, returned to the front of the store and fired several shots at the man's car before jumping into another car and fleeing west on 2nd Street.

"I woke up, looked outside. . .it was chaos out here," one resident told Action News.

"Any time you have people shooting guns indiscriminately like this, it's dangerous for everybody," said Wilmington Police Master Sergeant John O'Conner. "It's an example of how people don't worry about what they're doing out there anymore."

Police say the suspects and man they were chasing knew each other and had been involved in some kind of ongoing dispute.

The man being chased turned up at Christiana Hospital about an hour later with a gunshot wound to the thigh. He is now listed in stable condition.

After examining surveillance video of the incident, detectives and a SWAT team descended on the 1100 block of Pleasant Street in Wilmington. Armed with a search warrant, they took one of the male suspects into custody along with a woman. They also recovered the rifle believed to have been used in this incident.

Behind bars tonight is 46-year-old Frank Diaz of Wilmington. He is charged with attempted murder, possession of firearm during the commission of a felony and related offenses.

The woman has not been charged.

Police are still looking for 23-year-old Luis Ortiz of the unit block of Moorehouse Drive in Wilmington.

"He should be considered armed and dangerous," said O'Conner. "There is still the potential for a weapon to be out there."

Police say the wounded man and the suspects knew each other and had been involved in some kind of ongoing dispute.
